Appellant was charged with the misdemeanor offense of possession of marihuana and entered a plea of guilty. The trial court deferred adjudication and placed appellant on probation for a period of six months. Prior to the end of the probationary term, the State moved to adjudicate appellants guilt. After conducting a hearing on the States motion, the trial court found appellant guilty, imposed a fine of $800, and sentenced appellant to six months in jail. Notice of appeal was timely given and the conviction was affirmed in an unpublished opinion. Phynes v. State, No. 2-90-002-CR (Tex.App.-Fort Worth, delivered October 19, 1990).
